Judge denies change of venue motion in Childress murder case

A Whitley Circuit Judge has overruled a motion at least for the time being to move a well-publicized murder trial to McCreary County or in the alternative to have the jury sequestered during the trial.

“We have to at least try to get a jury” seated in Whitley County, Judge Dan Ballou said in response to the motion Monday afternoon in the case of Adam David Childress.

A Williamsburg man, who allegedly ran over and killed a man out walking his dog along a sidewalk about five months ago, has asked a Whitley County circuit judge to throw out the results of his blood alcohol test, which was taken after the crash.

However, based on the judge’s preliminary ruling Tuesday afternoon, it doesn’t look as if the defendant will be successful in his efforts.

VFW’s insurance carrier denying claim over fatal wreck

Adam Childress is accused of murder after allegedly getting drunk at the VFW in Williamsburg and running over a man on a sidewalk. The case has sparked various litigation.

A case involving the death of a Williamsburg man, who was run over on a sidewalk in April by a man who had allegedly been drinking at VFW Post 3167 prior to the accident, has taken some unique turns in recent weeks.

The insurance carrier for VFW Post 3167 is suing the post in federal court in an attempt to avoid paying a claim related to the death. Also, the insurance carrier has officially been added as a defendant in the Whitley Circuit Court lawsuit against the VFW and the man charged with driving the vehicle.

In addition, the prosecutor in the criminal case is trying to keep lawyers for the victim’s estate from taking the deposition of an officer, who helped investigate the case, and is trying to prevent civil attorneys from getting their hands on evidence in the criminal case.

Grand jury indicts Childress for murder

A Whitley County Grand Jury indicted a Williamsburg man Monday morning for murder in connection with the vehicular death of a Williamsburg man, who was run over while walking his dog along a sidewalk last month.

The grand jury charged Adam David Childress, 31, with murder, leaving the scene of an accident and operating a motor vehicle while under the influence in connection with the April 13 death of Richard Perkins.

Childress was not transported to court Monday.

Whitley Circuit Judge Paul Winchester scheduled a June 20 arraignment for Childress.

Perkins estate sues Childress, VFW Post

The estate of a Williamsburg man, who was allegedly run over and killed last week by a drunk driver who left the scene of the accident only to have another crash minutes later, is suing the alleged drunk driver and the VFW post where he allegedly got his alcohol.

Margie Woodruff, as Administratrix of the Estate of Richard Perkins, filed suit Tuesday in Whitley Circuit Court against Adam David Childress and Pierce Dant Hamblin Post No. 3167 Veterans of Foreign Wars of the United States Inc.

Childress is charged with murder, driving while under the influence and leaving the scene of an accident in connection with Perkins April 13 death.
