ADVERTISEMENT FOR BIDS

Cumberland Falls Highway Water District

Line Replacement and Reinforcement Project – Contract 4

Separate sealed bids will be received for the construction of Line Replacement and Reinforcement Project – Contract 4 by the Owner, Cumberland Falls Highway Water District, at 6926 Cumberland Falls Highway, Corbin, KY 40701 until 10:30 AM local time on November 12, 2024. Bids will be publicly opened and read aloud at the Cumberland Falls Highway Water District Office.

Line Replacement and Reinforcement Project – Contract 4 includes installation of approximately 3,000 linear feet of 4” and 3” PVC waterline and all necessary appurtenances.

The CONTRACT DOCUMENTS may be examined at the following locations:

Copies of the CONTRACT DOCUMENTS may be obtained from Lynn Imaging, 328 Old Vine Street, Lexington, KY 40507 (859-226-5850) and www.lynnimaging.com upon payment of a nonrefundable price of $175.00 for each set plus any shipping charges.

All bidders shall submit with their bid a Bid Bond in amount of not less than five (5) percent of the base bid.  No Bidder may withdraw his bid for a period of ninety (90) days after the scheduled Bid Opening Date.  The Bidder awarded the contract shall execute a 100% Performance Bond and a 100% Payment Bond and shall furnish insurance as required, in the General Conditions.  The Bidder awarded this contract shall complete this project within 30 calendar days after date of authorization to start work. Liquidated damages will be assessed at $1,000 per calendar day.

This project is funded in part with funds provided by the Kentucky Drinking Water State Revolving Loan Fund (SRF) with federal funds provided by the Environmental Protection Agency.  SRF requirements (including American Iron and Steel (AIS) and Davis-Bacon Act) and provisions must be met by the Bidder and all subcontractors. Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A – Agriculture, Rural Development, Food and Drug Administration, and Related Agencies, Appropriations Act, 2017) and subsequent statutes mandates domestic preference applies to American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. The term “iron and steel products” means the following products made primarily of iron and steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The de minimus waiver applies to this contract.

Bidders must comply with the President’s Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin.  Bidders must comply with Section 3, Section 109, and Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act and the contract Work Hours Standard Act.  Bidders must certify that they do not, and will not, maintain or provide for their employees any facilities that are segregated on a basis of race, color, creed, or national origin. Award of Contract will be made to the lowest, responsive, responsible bidder. Any bid that is obviously unbalanced may be rejected. Cumberland Falls Highway Water District reserves the right to reject any and all bids and waive informalities.

NOTICE OF BOND RELEASE

Permit # 861-0578

In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Suite 100, Corbin, Ky 40701, has filed for a Phase I Bond Release of permit number 861-0578, Increment 10 which was last issued on 05/06/2024. The application covers an area of approximately 416.5 acres. The area is 2.5 miles northwest of Permon, Kentucky, in Whitley & Knox Counties and is approximately 1.2 miles north of the intersection of Hwy 779 and Hwy 1418 and located 0.02 miles west of Flat Creek and 1.6 miles north of Cotton Creek.

The bonds now in effect are as follows:

INC 10 Surety bond in the amount of $255,800.00. Approximately 60% of the original bond amount of $255,800.00 is included in this application for release.

Reclamation work performed includes Backfilling, re-grading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan, completed 09/06/2024.

This is the final advertisement of the application. Written comments, objections, and requests for a public hearing of the informal conference must be filed with the Director, Division of Field Services, 300 Sower Boulevard, Frankfort, KY 40601 by 11/29/2024.

A public hearing on the application has been scheduled for 12/02/2024 at 9:00 am at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by 11/29/2024.

 

NOTICE OF INTENTION TO MINE

Pursuant to Application Number 861-8018, Renewal 8

In accordance with KRS 350.055 notice is hereby given that Arq Corbin, LLC, P.O. Box 474, 3318 KY 3041, Corbin, KY 40701 has applied for renewal of a permit for a prep plant, coal recovery and reclamation operation located 0.25 miles east of Corbin in Knox and Whitley Counties. The operation disturbs 470.5 surface acres.

The operation is approximately 1 mile south of US 25W’s junction with KY 312 and located on Lynn Camp Branch.

The operation is located on the Corbin U.S.G.S. 7-1/2 minute quadrangle map. The operation is a coal recovery operation. The surface area is owned by CH Development L.L.C.

This is the final advertisement of the application. All comments, objections, or requests for a permit conference must be received within 30 days of today’s date. The application has been filed for public inspection at the Division Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY, 40965. Written comments, objections, or requests for a permit conference must be filed with the Director, Division of Permits, 300 Sower Boulevard, Frankfort, Kentucky 40601.

 

NOTICE OF INTENTION TO MINE

Pursuant to Application Number 918-8016, Major Revision 4

In accordance with KRS 350.070 notice is hereby given that ARL Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for a major revision to an existing surface coal processing facility located 1 mile north of Pleasant View in Whitley County.  The major revision will add 0.0 acres of surface disturbance making a total area of 13.03 acres within the revised permit area.

The proposed major revision is approximately 0 miles east of US 25W junction with Cane Creek Road. And located approximately 0.1 miles northeast of the junction of Cane Creek and Clear Fork.

The proposed major revision is located on the Williamsburg U.S.G.S. 7½ minute quadrangle map. The surface area to be affected by the major revision is owned by ARL Resources LLC

The major revision proposes to change the existing post-mining land use of pastureland to industrial/commercial land.

The major revision application has been filed for public inspection at the Division of Mine Reclamation and Enforcement, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229.  Written comments, objections or requests for a permit conference must be filed with the Director, Division of Mine Permits, 300 Sower Blvd. Frankfort, Kentucky 40601.

 

PUBLIC NOTICE

On October 18, 2024, Louisville Gas and Electric Company and Kentucky Utilities Company filed their 2024 Joint Integrated Resource Plan with the Public Service Commission of Kentucky. This filing includes a load forecast and resource plans of Louisville Gas and Electric Company and Kentucky Utilities Company to meet future demand with an adequate and reliable supply of electricity at the lowest possible cost for all customers within their service areas. Comments regarding the Integrated Resource Plan may be submitted to the Public Service Commission by mail to Public Service Commission, Post Office Box 615, Frankfort, Kentucky 40602, or by email to at psc.info@ky.gov. All comments should reference Case No. 2024-00326. Any person interested in participating in the review of this Integrated Resource Plan should submit a motion to intervene in Case No. 2024-00326.
