Public Notice

For Solid Waste Management Plan Update 2012-2017

The Whitley County Fiscal Court proposes to adopt the county’s Solid Waste Management Plan update per 401 KAR/49:011, Section 5. The plan, if approved, will serve as the basis for handling solid waste management issues in Whitley County (including the cities of Corbin and Williamsburg), for the years 2013-2017.

The proposed plan is available for public inspection beginning August 1, 2012 at the following location during regular business hours:

Anyone unavailable to review the plan at the above locations may call or email and request that a copy be mailed or emailed to them.

Any person wishing to comment on the plan may do so by providing comments no later than the close of business on the 30th day of this public notice (August 30, 2012), to the Whitley County Fiscal Court, Williamsburg, KY 40769.  Any person wishing to be heard at a public hearing must make a request via telephone, fax, email, or written communication, to the governing body identified above, no later than 4 p.m. on the 30th day, Thursday, August 30, 2012.

A public hearing is scheduled on August 31, 2012 at 10 a.m. to receive public comments on the plan.  The hearing will be held in the Whitley County Fiscal Court room on the second floor of the courthouse.  However, if no request for a public hearing has been received by close of business, 4:00 p.m., August 30, 2012, the hearing may not be held.

The Whitley County Fiscal Court will respond to all written public comments within fifteen days after the end of the public comment period and will consider the plan for passage at the September 18, 2012 fiscal court meeting at 6 p.m.  The plan, if approved, will then be submitted to the Kentucky Energy and Environment Cabinet for review and approval.

CDBG CLOSE-OUT PUBLIC HEARING ADVERTISEMENT

PUBLIC NOTICE

This notice is intended to inform the residents of Whitley County, Kentucky that the Whitley County Fiscal Court, is in the process of closing out the Whitley Co. Zero Energy Homes CDBGR Project.  The project was funded in part by the Kentucky Community Development Block Grant Program.  A public hearing will be held at the Whitley County Courthouse, on     Friday, August 17, 2012 at 12:15 p.m.  The purpose of this hearing is to review past use of funds and program performance.  If there are any questions or comments about the project, please direct them to the following:

Public Hearing Notice

To all interested citizens of Whitley County, Kentucky:

The Kentucky Department for Local Government is accepting application material under the 2012 Community Development Block Grant (CDBG) Program. Whitely County intends to apply for assistance to provide funds for housing activities in Emlyn.  The County will hold a public hearing prior to the submission of the required application forms for the housing program area.  The public hearing will be held on Friday, August 17, 2012, at 12:30 p.m., at the Whitley County Courthouse, 200 Main Street, Williamsburg, KY.  The purpose of this hearing is to obtain views on housing and community development needs, review proposed activities, review the proposed applications, and solicit public comments.  Technical assistance is available to help groups representing low and moderate income persons in developing proposals.

The following information concerning the CDBG program is available for public inspection at the office of the Judge during regular business hours:

A. Amount of funds available and range of activities that may be undertaken.

B. Estimated amounts of funds proposed to be used for activities benefiting persons of low and moderate income.

C. Plans for minimizing displacement of persons as a result of activities associated with CDBG funds and plans for providing assistance to those persons to be actually displaced as a result of CDBG-funded activities.

D. Records regarding the past use of CDBG funds.

E. A summary of other important program requirements.

Comments on Application

A copy of the CDBG application material will be on file at the office of the Judge for citizens’ review and comment during regular business hours from Friday August 10th, from 8:30 a.m. through 4:30 p.m. through Friday, September 17, 2012.  Comments on the proposed application may be submitted to the attention of the Judge until 4:30 p.m., Friday August 17, 2012.

BRIDGE REPLACEMENT RFP

Little Wolf Creek Road Bridge

Sealed Proposals for the following work will be received by the Whitley County Fiscal Court in the manner and on the date hereinafter specified for the furnishing of all labor, materials, supplies, tools, equipment, services, etc., necessary for the removal of the existing structure and replacement of a Little Wolf Creek Road Bridge.

Agency must submit their bids to the Whitley County Judge Executive at the Whitley County Courthouse, 210 Main Street, Williamsburg, Kentucky, on or before 2:30 p.m. local time on August 20, 2012, at which time bids will be opened and read aloud.   Bids will then be presented to the Fiscal Court at the regular scheduled meeting at 6:00 pm on August 21, 2012.  Bid envelops shall be marked “Little Wolf Creek Bridge Bid” on the front of the envelope or package.

Contractor must be pre-qualified by the Kentucky Department of Transportation.  Proof of pre-qualification shall be included in the bid proposal.  Contractor shall provide the Whitley County Fiscal Court proof of Liability Insurance and a bid bond equal to ten percent (10%) of the total bid.

Bidder must present a Kentucky Engineer stamped set of plans to the Whitley County Fiscal Court after bid has been awarded.

Whitley County Fiscal Court will procure all necessary permits prior to installation.  Whitley County Road Department will be responsible for backfilling both ends of the bridge to road grade.

Completion date will be 30 days after permits are obtained. A Notice to Proceed will be made in writing to the awardee.

Project may be bid as a complete package or it may be bid separately detailing concrete materials with installation and/or metal deck.

Conflicts of interest, gratuities and kickbacks are defined in KRS 45A.445 and as provided for in KRS 45A.445 are absolutely prohibited. 

No bidder may withdraw his/her bid for 90 days after the date the bids are opened.  Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.

Whitley County reserves the right to waive any informality and may reject any and all bids. Notice of Intention to Mine

Pursuant to Application Number 918-0435

In accordance with KRS 350.055, notice is hereby given that Alden Resources LLC; 332 W. Cumberland Gap Pkwy., Suite 100; Corbin, Kentucky 40701 has applied for a permit for a surface coal mining and reclamation operation. The proposed operation will disturb 65.3 surface acres and will underlie 17.4 acres, and the total area within the permit boundary will be 82.7 acres. The proposed operation is located approximately 0.5 miles south west of Hamblin Hollow Road’s intersection with Poplar Creek Road, and approximately 2.5 miles north east of the community of Verne, in Whitley County, Kentucky.

The proposed operation is located on the Saxton U.S.G.S. 7 1/2 minute quadrangle map. The operation will use the Contour and Auger methods of mining. The surface area is owned by Nancy Monhollen, Marjorie Randle, Kenneth Monhollen, Katherine Monhollen, Fay Wilson, Emile Patry, Nancy Patry, Diana Horn, and Karen Hamblin. The operation will affect an area within 100 feet of Hamblin Hollow road and Randle Cemetery road. The operation will not involve relocation and/or closure of a public road.

The application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office; 1804 East Cumberland Avenue; Middlesboro, Kentucky 40965-1229. Pursuant to a Judgment and Order of Sale entered by the Whitley Circuit Court on June 11, 2012, I shall offer for sale at the door of the Whitley County Judicial Center, (new courthouse), 100 Main Street, Williamsburg, Kentucky, at public auction on Monday, August 20, 2012, at 12:00 p.m., or thereabout, the real property described in this Notice.
